View Full Version : Last day of fishing the now closed Scripps area

Yesterday was the last day to fish the now closed areas brought about by the MLPA.
We arrived in the dark, about 5:45AM, and landed at the launch in the dark, about 5:45PM.
Gorgeous day out, flat ocean, little or no wind, and tiny surf for launching and landing, although upon landing we did time (in the dark) it wrong, like we are so good at, at finding the biggest wave. Only about a 2 footer, Julie rode it in, I decided to back up and wait, which rewarded me with a big splash of seawater to the back.
Made plenty of macks just past the south buoy markers, then started to fish.
Lots of PBers and yaks out today mostly concentrated outside of the kelp and in front of the condo, the area I was told, where the yellows went off a week and a half ago (12/21 & 12/22). We can’t imagine what it will be like, when this area is the only place you’re allowed to fish this summer.
We made a pass through the area, then went outside of the group and a little north. Still nothing, so we went back to the kelp line to try for taco meat on cut squid. We managed 1 calico bass, and 1 brown rockfish.
Our plan for the day was to drift for halibut by Scripps pier, and maybe locate the spot in the Scripps canyon, where MattRabasco nailed some goats a couple of days ago. Both of these areas are now closed, thanks to the MLPA. The year Julie caught her world record halibut, sorry to say, we lost 3 halibut, in a 3 week span, on gaff, in the area we drifted yesterday. I did not hit the sweet spot and they went mental, but I’ve learned. A conservative estimate on their weights 25lbs, 40lbs, 60lbs, +/- 5lbs on the first 2, +/- 10lbs on the last one, which would easily have broken Julie’s Women’s world record. I should know I put the gaff in both, and we both saw it.
No love from the halibut. We don’t have a fish finder, but knew about where the Scripps canyon was located. After bouncing the 10oz halibut rig, we finally located the canyon. With less than an hour ‘til dark, we located, where we think the goats were caught, but only managed 3 more small Reds.

Here’s our taco meat photo for the day:

With daylight fading, we started the paddle back, both of us talking about how we would never be likely to ever fish these spots again. We were saddened and angry.
I’ve been fishing for 45+ years, ocean fishing for 40+, and Julie about the same, maybe not always to the same degree until she met me. Fishing on the kayaks off of La Jolla has easily become our #1 passion(a good tuna bite is next), not just because of excellent fishing, but the beauty, too. It is our hope that every person responsible, for the MLPA, also lose their greatest passion. If it’s good food, gone should be your sense of taste. Watching good movies partial blindness (not total, we don’t want to seem mean). Sex, may your pecker fall off, or your womb close. Etc, etc, etc. You get the idea.
MLPA and the people behind it, have not only taken away much of the pleasures of a million ocean fishermen or more, but also countless thousands who rely on it as a livelihood. Sport boats, Charters, Bait boats and receivers, Commercial fishermen(lobsters, urchins, etc), Tackle Store owners/Manufacturers, etc, all will feel a major financial blow. I feel sorry for guys like Andy (Iceman), who started their own kayak store. If Julie and I knew this was going to happen 8 years ago when we started this sport of kayak fishing, we very likely wouldn’t have bought our ‘yaks. Don’t get us wrong, they have been worth the investment over those 8 years, but as of today, a huge portion has been ripped out.
Gone, is the location I started fishing off South Laguna from shore, 35 years ago, where I caught sheephead, calicos, halibut and up to 13 species in 1 day. Gone are the tremendous locations off of Palos Verdes, where I learned to fish from the half day trips out of Redondo (the City and Special), 40 years ago. Now gone too, are many wonderful spots in our dear La Jolla. Plus, the dozens and dozens of locations up and down the coast.
Thank you America, too, for allowing this to happen. Helmet laws, checking your shoes at airports, and now depriving fishermen the right to fish in local waters, which is completely unnecessary due to proper DFG limits, What is next, the right to breath, to be?
We hate the MLPA, and despise those involved in it’s passing.

Probably the only male/female couple kayaking yesterday, and if they were fishing in white kayaks (Cobra Fish 'n' Dives), then yes, that's us.
Julie hooked a seal, too. A great way to wear you out, if being on the water 12 hours, loading and unloading gear twice, wasn't enough.

Arron, the second part of your post was one of the best I have heard or read about what the mlpa really means to the people of California and to you personally. Thank you. I have seen this whole "process" as a barely conceled theft of our public resoures. Things should get extremely interesting now that the "good ideas" are over and the real enforcment and monitoring begin. Our state is laying off teachers and firefighters, who the hell is going to patrol these massive areas? Mike

I said Happy New Year just before dark at Blacks. I think you were the last person to catch a legal fish there, I was the last person to fish there legally. That last day was like attending a wake for a lifelong friend.
Many of us attended meetings and rallied family and friends to attend meetings and mail in written statements. Would have been nice to see more Americans stand up for their rights rather than just complain about it after the fact.
Happy New Year all.

We totally agree, how are we to respect what's not right.
Ignorant people created this mess, and we won't have any problem if we see any of you fishing in these areas.
But, on another note, we still should abide by the "rules and regs" already in place by the DFG, like size/quantity limits, seasonal closures, etc. To that point, we would hope Billy V, that you didn't catch those rockfish on Jan 1st, knowing their season is now closed. We could care less if you caught them in an MLPA area on March 1st, when the season opens again. But, it's not in our best interests as fishermen to break the already established laws set by the DFG.
But, MLPA is wrong, and that new "law" for closures, as Yaky Yak said, doesn't deserve our respect.

That area wasn't closed today, I fished there all afternoon:reel:for legal size halibut. Seriously, buying a fishing license is only sending DFG the message you agree with how they are managing resources...do you?

What puts more money in the DFG's pocket, a $43 license, or the countless tickets they will be handing out knowing people are going to fish without them. Expect heightened presence at landing areas. You're not going to win by not buying a license. You're like a child holding his breath because he didn't get his ice cream.

Lets say for the sake of simple math that 1 million licences get sold each year. If you were to mobilize every BWE member not to buy one for a while you would possibly create a .5% temporary delay in funds to the state.
As much as this might make someone feel better, or like they are making a stand, it would mean absolutely nothing to the state.
Fishing without a licence is another option that may not be the best choice for us anglers. Last thing we want to be portrayed as is a bunch of lawless "fish killers".
Remember, the DFG is enforcing the laws created by someone else.
I was thinking about picketing in front of a retail location of one of the companies that financially aligned itself with the MLPA. This would not require great numbers but maight send a more precise message.

We agree with you and Blitzburgh, and we would love it if anyone could provide a partial/complete list of all companies and organizations (Green Peace, etc) who aligned themselves with the MLPA. Boycotting companies products, and emailing all of our own contacts, fishermen or not, to do the same, may at least put a dent in their pocketbooks.
An organized picketing in front of these establishments would definitely have a more immediate impact, and if media is involved, even that much better.

When they made painting your home a require a permit no one spoke up.
When they made bbq smoke a polutant instead of an attraching smell to the resturant...no one spoke up.
when your semiauto "dangerous looking " gun became illegal...no one spoke up.
so why now when the liberals here in california have run amok of your freedom do you expect anyone to protest for you.

I'm probably the fucking democrat voting environmentalist leaning fisherman you speak of. No worries, it takes more than that to offend me. Maybe I didn't know who your were but I don't remember you being there or speaking up. Not trying to offend, but if you think voting republican is going to preserve your freedoms, you haven't been paying attention.

Sure some of you will say that voting for a particular party won't make a difference anyway...and maybe you are right....but at least it only cost me what it takes to drive to the polling place.
To those of you that actually spent time and effort to stop this process I want to thank you.I hope it feels good that it made almost no difference at all in a state run by democrats from the assembly to the senate. We here have been ruled by democrats for what ,... at least 30 years.Governors that were voted in that were republicans have had their proposed rules ,regulation and laws either refused by the senate and assembly or the antis shopped till they found a judge to rule in their favor.
California is a state in decline ....not because the geography or the will of the people have changed ...because the "leaders" we elected(not me) have consistantly disreguarded the will of the people.
go ahead pop the corn ,sit back and be polite about the idiots that vote without paying attention other then collecting their check every month.
Your silence at parties ,in the office ,or at the beach while launching your yak is rewarded with your loss of the freedom to fish within the constraints of good fisheries management.
I hope your happy with the results.
I'm pissed.....I lash out at those of you that vote for democrats because I percieve that ,compared to republicans, they are the party that most often represents the people that destroyed my favorite fishing spot since the first time I fished it back in 1975.If you think differently don't be silent.....this is a discussion that needs to be aired out in a public forum.

I hope it feels good to be ignorant. Almost no difference? The better part of LJ is open. The enviros wanted the entire thing. They were desperate to get it. We turned them away. That was a huge difference, and it didn't happen by itself. Or maybe you're from Laguna. Then you're right. The blue bloods (or is that blue hairs?) won. Or Dume up in Malibu, movie star land? There weren't enough fishermen to defend our turf. Maybe you stayed home?
Other zones that went the fisherman's way:
Rocky Pt at PV
Catalina west end
Carp Reef
Pyramid Cove
I could keep going. It would have been much worse if people hadn't stood up. Too bad more didn't show, enough to shut down the hearings. I didn't miss one. When we had the numbers, events went our way. When our people faded, nightmare.
Every time one of us paddles out to north LJ kelp, dives there with a spear, or drops a line from a boat this community should feel proud for showing up and speaking too loudly to be ignored. It would be closed now without the kayak fishing crowd.

Stairman, did you vote for the republican Schwarzenegger? I did, and I regret it now. Who did you vote for? You come on here and bad-mouth me yet you did nothing to help defend our rights. Let's continue the discussion buddy. I'm a military veteran who votes every time and I stand up and speak up when needed. What have you done?

don't forget you can still catch your bait in the scripps area....
I usually catch bait using a flylined 2/O hook... its funny how the mackerel hook themselves through the nose everytime :D
What are the regs for that? If you do catch a yellow or halibut while making bait? Are you supposed to release? What if you cant, I once foul hooked a YT at blacks in the gill. Zero chance of survival.... Can you keep bycatch in that case?

good question. Legally I don't think you could keep it, regardless of its potential to survive...
I'm would assume you're supossed to cut the line immediately, but I doubt there are any rules or regulations that have been written up to address such a case.
Legally I don't think anyone could prove anything in regards to this kind of situation.
This is one of the biggest reasons why I'm pissed off about the Scripps area being closed.
It doesn't make any sense to close the area to pelagics but leave it open to coastal pelagics.
This is just another example of how the whole MLPA process was flawed, biased, and twisted by the enviros.
The stupid enviros don't even know the difference between what making bait and catching fish looks like!
Its just stupid.

I saw you at a lot of those meetings Paul....thanks for all your help. You are right...if we weren't there in the numbers we were we would have lost a lot more. The other side was bussing school children in for goodness sake. If we hadn't been there much more would have been closed. don't get me wrong......We lost some great spots but the damage would have been far greater.
One thing i did recognize was that the system was flawed and if you were going to get anything done you were going to have to be on the inside.
That is why I am running for city council in San Diego. It's time to quit just going to meetings and donating money. It"s time to stand up (get of the yak temporarily) and make a difference.

I think it is funny that the MLPA uses the term "coastal pelagic" to refer to bait, because to me WSB is a coastal pelagic.
To your question as to why coastal pelagics are the only think allowed for take, my understanding is that the area was suppose to be a full SMR (zero take) and the Efferingham(sp) brothers said they need the area to make bait and your lot (the kayakers) fought hard to keep the right to make bait at the pier and canyon. And the game warden who parks at base of the pier or watches from the top of blacks knows the difference between a sardine and a yellowtail.

true... wsb should be reclassified realistically...
I knew why it was left open to catching bait....
It just doesn't make sense to me that you would allow big boats like Evingrahms to come in and purse seine a ton of sardines when you won't let a few recreational fishermen catch one or two yellowtail.
Yeah, I would hope the warden knows the difference between a yellowtail and mackerel up close.
But I doubt the warden would be able to tell from distance if you were catching bait, soaking bait, or hooked up to a big fish..... its pretty easy to hide a bendo if you try.
I have been less than a 1/4 mile from people that were bent on big yellowtail and I didnt even notice!
Funny thing, coastal pelagics (bait) in the MPA north of the pier is open only to recreational take. When they cut that deal to allow us to continue fishing bait at the pier (a concession we ripped from them - :you_rock: Tyler), Everyingham was supposed to have access too. Somehow they "lost" that part.
If you ask the DFG, they'll tell you fish that aren't legal to take (yellowtail north of the pier) must be released even if that means dead. The same principle rules rockfish. Say you pull up one too many bloated salmon grouper or canary, you've got to leave it as a floater or risk a fine.

which never made any sense to me at all...what are you gonna do...
Sherm,
I hope you go all the way...and I promise to not refer to you as one of "those politicians" this state needs more than one of you in office for the good of the people...I support you 100%

Thanks amigo. We need a business man and outdoor enthusiast on the council. The second largest city in the state has to have some clout to help slow this down.

Since you brought it up "you running for city council" as I know you've solicitied people close to me for support;)
Im curious what exactly would that do for us regarding issues like this that have already gone into effect on a statewide level?

Paul's been one of the main men, fighting for our fishing rights.
All true fishermen will be frustrated at this whole MLPA thing. If you don't appreciate what HAS been won, then maybe you're from the other side.
Thanks, Paul, and to the countless others that gave us a little bit of our jewel.
MLPA is wrong, the people behind it are thoughtless bastards/bitches, and the whole thing sucks. But, until they get more extreme, we can hold off on going postal.

No worries, hope I didn't offend you either. But I can't help pointing out that it was a republican governator that supported the MPLA's and it's flawed process and allowed this to happen. Well, that and a bunch of you people reading this that did nothing when many of us were asking for your help. You people only speak up after the hard work has been done. Well, you have been measured, you have been weighed, and you have been found wanting.... I always wanted to use that line. :)

Im buying around ten of these type kayaks (fully outfitted, pfd's,and all the fishing gear to go along).I'm spearheading a project for a school recreation effort to teach kids to swim, kayak, and fish in a small south Baja village. I should have elaborated more.:)
