What's the law on alcohol and kayaking??

I see guys having a beer or two and I do myself ... while fishing. So I was wondering what the law actually is... Is it like drinking and driving DUI or riding a bike and drinking a beer?? Because you can get a DUI riding a bike because it's considered a vehicle. Is a kayak considered a vehicle like a bike or a boat? not really sure... And is it different in the harbor than in open water? I know on a boat the passengers can drink but the driver cannot if you're the driver on kayak and is it like riding a bike in Huntington Beach with a beer in your hand on the strand.

I would think no motor would allow you to have a couple beers. But in sure you would have to be a distance from shore since it's against the law on the beach. I'm sure someone will quote the law here .

If I see you drinking I may have to confiscate at least one of your beers :cheers1:

ful-rac 03-21-2014 09:17 PM

Just drink your beer and be happy...i wouldnt reccomend getting wasted out there though....bring enough for everybody while your at it

Rambo 03-21-2014 09:24 PM

Just what everyone stated.. Just drink and don't be stupid. They know Most people are drinking on their vessel.

alanw 03-21-2014 09:29 PM

That reminds me, I had my kayak searched last weekend by a DFW warden. I had empty beer cans in the foot area and he said nothing during his search for illegal fish.

Which also reminds me, never consent to a search.

Hahaha. All good replays my only worry is the Coast Guard and the OC sheriff in Newport Harbor
@ yakdout bikes don't have motors either. And you can get a DUI on a bike So that's why I'm wondering... And Tony if I remember right Vodka good guy.
To be honest usually take three beers for the ride. No more for less. But just don't want to get busted for having a good time you know..?

Loudog 03-21-2014 09:42 PM

Not saying getting blasted just having a couple of beers, and maybe even a cigar... Come on sometimes on a boat by yourself it's just the freedom. Maybe you don't have a beer and you just have a coffee. That's cool too... But the whole idea is to have fun and I don't want the Coast Guard rolling up on me for a beer.

William Novotny 03-21-2014 09:49 PM

Just drink your beer and be responsible. I think everyone on this board that partakes has a few cold ones on the water. Shiiiit I've made a thermos full of ice cold Margarita to take out. Complete with plastic Margarita glass, lime and salt. That was a great day

The coast guard is in the bay busting drunk powerboaters. Never seen one in LJ. Always have a sixer. I do. You make more friends that way.:cheers1:
Cheers

Per Ca. Code 548245.42. Any person that is engaging in fishing out of a kayak in California waters that does not have beer on board. Will be prosecuted to the fullest extent of the fisherman's code of conduct and such punishment shall be to be keelhauled under a Pa 14 until said fisherman has seen the error or his (or her) way and has bought beer for every fisherman on the water.

Loudog...we missed you at the last Sewer/Lake Irvine overnighter. Definitely way less vodka consumed by Tony but Caden went off on whatever he was drinking. He popped out some mini-speakers and hooked them up to his iphone. I just about threw it all into the fire...

Roby wet Matt's bed, word. Lots of very good food. Next time Holmes. Jim

I love it! I always take a six pac of Tecate (in cans of course). In the 9 to 12 hrs spend fishing and paddling my x-factor I never feel like I'm too drunk. The amount of time and work out lets my body process it so there's no ill effect. I like Will's idea of the thermos with margaritas, plastic glass and salt, might have to try that on a trip this summer. Tight Lines

Should be a law against drinking Tecate :the_finger:

which is better for you, alcohol or weed?. would one or the other would help impair my judgment to the extreme ? need some rock solid info from you pros out there.

Cadillyak 03-22-2014 09:33 PM

Gotta have brews on board. I'm an IPA man myself, so with ballast point using cans now, I can bring bigeye and sculpin on the water with me.
